Acceptance of Terms and Conditions of Use

These terms and conditions (“Terms”) govern your use of European Crypto Party website with the domain of europeancryptoparty.com (“Site,” or “ECP”), operated By  Tehnoreal d.o.o., Preloge 16, 8230 Mokronog, Slovenia (“we,” “us,” or “our”). By accessing and using the Site, you agree to comply with these Terms. If you do not agree with any part of these Terms, you should not use the Site.

1. Intellectual Property

1.1 Ownership: 

All content and materials on the Site, including but not limited to text, images, graphics, logos, videos, and software, are the intellectual property of ECP or its licensors and are protected By applicable intellectual property laws.

1.2 Transfer of ownership, content and data:

Tehnoreal d.o.o currently represents ECP. However, if decided By the founder with the highest share of the project, or all the founders, that it would be beneficial that the ECP is represented By another company, firm, business entity, political party, association, or organisation, the Site may be transferred accordingly. Any transfer of the ECP rights or obligations will be binding upon you. If you do not consent to the transfer, you will stop your cooperation with ECP with immediate effect without any remuneration. If you stop cooperating with ECP, you agree to the termination of any rights that you may get in, at or with the ECP. The new company, firm, business entity, political party, association, or organisation representing the ECP will directly or indirectly require all or substantially all of the assets or business or data of Tehnoreal d.o.o. directly or indirectly connected to the ECP.

2. User Conduct

2.1 Prohibited Activities:

You agree not to engage in any of the following activities while using the Site:

a) Violating any applicable laws, regulations, or third-party rights;

b) Attempting to gain unauthorized access to the Site or any related systems or networks;

c) Interfering with the proper functioning of the Site;

d) Collecting or harvesting personal information of other users;

e) Uploading, transmitting, or distributing any malicious software, viruses, or harmful content.

4.3 Communication methods:

When using means of communication, such as emails or the contact form on our Site, you accept that any unencrypted messages sent over the internet are not secure, and we are not responsible for any damages incurred By sending information in this way. We currently do not support PGP-encrypted emails. There is a risk in sending unencrypted emails. Therefore, only reveal the information you do not consider confidential or harmless. As of September 2 2023, we will not respond with PGP-encrypted emails. Therefore you accept the risks associated therewith.

5. Miscellaneous

5.1 European Crypto Party and/or ECP is a project that serves as a channel to connect people, e.g. crypto enthusiasts, and is meant to provide information and can be used to support people in establishing national crypto parties. ECP is not an established political party and must not be considered a political party, political body, political entity and/or politically exposed body and/or entity.

6. Limitation of Liability

6.1 Exclusion of Liability:

To the fullest extent permitted By applicable law, ECP shall not be held liable for any damage, loss of profit, loss of revenue, loss of time, loss of business, loss of opportunity, loss of data, or gross negligence arising out of your use or inability to use the Site or any content therein. You, as a user/visitor, are entirely responsible for your decisions and actions.

6.2 Force Majeure

If ECP is unable to perform the Services described and outlined in the Terms and Conditions of use due to factors beyond ECP’s control, including but not limited to an event of Force Majeure, change of law, change in sanction, change in regulation or any restrictions that will arise after the ECP Site launch, and if ECP is forced to stop its Site and/or Services, ECP is not liable. 

7. Modifications and Termination

7.1 Changes to Terms: 

These Terms and Conditions of Use were written on September 2 2023. European Crypto Party Site reserves the right to add, change or remove parts of these Terms and Conditions at any time and at its sole discretion. Any changes will be effective immediately upon posting on the Site. It is your responsibility to review the Terms periodically for updates.

By continuing to access or use our Service after those revisions become effective, you agree to be bound By the revised terms. If you do not agree to the new terms, please stop using the Service.

7.2 Termination:

ECP may terminate or suspend your access to the Site, in whole or in part, at our discretion and without notice if we believe you have violated these Terms or any applicable laws.

8. Governing Law

8.1 Jurisdiction:

These Terms shall be governed By and construed in accordance with the laws of Slovenia without regard to its conflict of law provisions. Any legal actions arising out of these Terms shall be brought exclusively in the courts of Slovenia. 

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable By a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

ECP and/or Tehnoreal d.o.o. will not participate in any claim when or where they are not legally required to participate.
